Because the police operation and evidential record contained multiple significant deficiencies (delay in arrest, failure to check marked notes, misdescribed seizure documentation and inadequate investigation) the court had a lurking doubt as to the safety of the conviction and therefore allowed the appeal, quashed the conviction and refused a retrial.
