Majority held the original sentences for the 1st and 3rd Applicants were manifestly inadequate given the deliberate conspiracy to gain access to and publicly expose a fragile protected witness, the 1st Applicant's role as instigator and financier and the 3rd Applicant's abuse of his position as a solicitor; accordingly the Court, exercising its powers under s.81B CPO, quashed the sentences and substituted custodial terms of 5 years for the 1st Applicant and 6 years for the 3rd Applicant; leave to appeal against sentence was dismissed for all three Applicants.
