Leave to appeal was granted limited to the arguable ground that the Court of Appeal departed from the established sentencing principle (prevailing guideline/tariff at time of offence), thereby reasonably arguably causing substantial and grave injustice; additionally, leave was granted for the 5th and 6th applicants on the distinct arguable ground that the Court of Appeal failed properly to consider section 109A of the Criminal Procedure Ordinance; other certified questions were refused as already answered and other grounds lacked sufficient merit.
