The Deputy District Judge's acceptance of credible eyewitness identification and congruent circumstantial evidence (tools, gloves, damaged ventilation and stool) provided ample basis to convict for attempted burglary despite absence of forensic linkage; there was no basis to overturn credibility findings and the appeals had no merit, warranting dismissal and an order that 3 months' detention pending appeal be excluded from sentence.
