The Court dismissed the application: the trial judge's directions on DNA were accurate and neutral given the evidence that sperm quantity was insufficient for profiling; directions on motive were permissible and accompanied by correct reminders of burden and standard of proof; and the sentencing judge legitimately exercised discretion to increase sentence because aggravating features rendered the original sentence manifestly inadequate.
