A bind-over order framed in general terms without precision is invalid for lack of legal certainty and must be set aside; consequential costs based on such an order fall with it.

Given the applicant's offences and wayward lifestyle, the absence of feasible alternatives (probation impractical due to youth and lack of parental support, imprisonment opposed by applicant and not serving purpose), and the fact that separation of mother and baby had already occurred with the baby in residential care, the court held that detention in a training centre remained the most appropriate sentence and dismissed the application for leave to appeal against sentence.

The Court upheld the District Court's exercise of discretion to detain the 20‑year‑old applicant in a training centre rather than impose immediate imprisonment because law requires consideration of alternatives for those under 21, DATC alone was insufficient punishment given the gravity of the attempted robbery, and public protection warranted the training centre order.
