The magistrate may have erred in rejecting the appellant's and DW2's evidence on credibility without addressing material supportive matters; where special reasons exist under s.4(2)(a) Cap.272 the proper construction is that no disqualification should follow (there is no statutory power to order a disqualification for less than 12 months), and on the facts the disqualification is set aside.
