The trial judge correctly applied Turnbull directions and was entitled to find the applicant identified by witnesses of prior acquaintance beyond reasonable doubt; trial counsel provided proper advice and the applicant\'s complaints did not establish grounds to overturn conviction or to grant leave out of time; however the one month sentence for refusal to provide a breath specimen should run consecutively rather than concurrently and the concurrent order was quashed under s83I(3) CPO.
