The appellate court held the Magistrate was entitled to infer a sinister motive from possession of a deliberately designed forged identity card and that Li Chang Li could be followed only if such an inference was sustainable; finding that inference sustainable, the proper starting point was 15 months, a one-third guilty plea discount and an additional one-month humanitarian discount produced a sentence of 9 months, and the original 11-month sentence was manifestly excessive.
