The conviction was upheld because there was ample evidence from immigration and customs (suspicious passports, possession of two passports, agitation and conduct) to satisfy a jury beyond reasonable doubt that the applicant knew of the heroin concealed in his bag; the sentence of 23 years was appropriate under established guidelines for a very large quantity of heroin (3,306g) and neither foreign nationality nor courier status warranted reduction, so both applications for leave to appeal were refused.
