The magistrate failed to give sufficient weight to the appellant's clear record and the trivial, spontaneous nature of the offence; consequently the original sentencing assessment was excessive and on appeal the appropriate sentence is two months to allow immediate release.

The appellate court held that the trial judge had not given sufficient weight to the substantial pre-charge delay, the appellant's cooperation with the ICAC, his early guilty plea and significant restitution; these factors justified reducing each three year sentence to two years, to run concurrently.

The appeal court held that the trial judge erred in inferring the appellant's knowledge of the girl's age and that the absence of an in loco parentis relationship reduced the weight of aggravation; accordingly the sentences of three years on each count were excessive and were reduced to concurrent terms of eighteen months per count.
