The application for leave to apply for judicial review is dismissed for want of prosecution due to prolonged inaction by the Applicant; however, on the exercise of discretion the Commissioner’s historical costs are not ordered against the Applicant and there is no order as to costs.

The Notice of Motion was dismissed because the applicant failed to comply with the unless order, did not apply for relief from sanction within the 14‑day period required by Order 2 rule 4, provided no acceptable explanation for the delay (including failing to notify a change of address), and demonstrated no error in the Court of Appeal's order nor any question of great general or public importance under s22(1)(b) to justify an extension of time under s24(5).

Extension of time refused because, although applicant's address error and delay were accepted and he acted promptly once aware, there was no real prospect of success in the intended appeal since no arguable grounds of judicial review were shown and it would not be in the interests of justice to extend time.

Extension of time was refused because the applicant failed to provide a satisfactory and prompt explanation for the delay, failed to inform the Court of his correct address so service was not impeded by the Court, and because the underlying judicial review claim lacked merit; in all the circumstances it was not in the interests of justice to grant an extension.
