The 2nd defendant was the appropriate person to represent the Estate because he was executor, co-owner, mortgagor/borrower and already a defendant; the alleged conflict of interest with the widow and sons was unsupported and effectively non-existent; the 2nd defendant's repeated non-attendance and failure to follow directions entitled the court to proceed in his absence and to appoint him to represent the Estate and carry on the proceedings.
