The court was satisfied the applicant was the registered owner entitled to redeem, the Mortgage remained extant, reasonable steps to locate the Mortgagee had been taken and had failed, and the proposed sum of HK$639.60 was reasonable to redeem the Mortgage (taking into account the amount owed and a notional 20% annual interest). Accordingly the court granted leave to pay HK$639.60 into court, ordered publication of notices, allowed the applicant to apply for a declaration under s12A(2) after the prescribed advertising and waiting periods, and made no order as to costs.
