Although the offence ordinarily required a substantial custodial sentence, the significant delay, ineffective attempts to arrest, and the respondent's subsequent conduct mitigated the sentence to be imposed on review; therefore the original bond was set aside and a custodial sentence of three months imprisonment was imposed.
