The application to add HKPA and to amend the writ was refused because the court will not dispense with service in rem (a fundamental requirement for in rem jurisdiction), there was no arguable case that HKPA was a bare-boat charterer, and the appropriate course is for HKPA to issue its own writ if it wishes to proceed; accordingly the application was dismissed with costs.
