The court found the plaintiff had established continuous adverse possession and control of the Lot for a period exceeding 20 years, the registered owner was shown to have died by satisfactory evidence, service and substituted representation steps were valid, and in view of the overwhelming merits the court departed from the usual practice against granting declaratory relief without trial and granted declarations extinguishing the defendant’s interests and vesting possessory title in the plaintiff.
