Order 73 rule 10A applies to the whole of s.44(2) including subsection (f) allowing the court discretion to order security; applying the two principal considerations (merits and ease/difficulty of enforcement) the court refused to order security for the claim (US$50m) because, given timing and risk of injustice to Pertamina, it would be inappropriate, but granted security for costs in the sum of HK$3,000,000 with a specified payment deadline and ordered the costs of the summons be in the cause.
