On the balance of probabilities the plaintiff proved she never sold the entitlements and that the signatures on the two assignments were forged; accordingly the court granted declarations that she never sold the entitlements, declared the assignments void, set them aside, ordered the registration vacated and ordered damages to be assessed; costs were awarded to the plaintiff on an indemnity basis.
