The agreed settlement phrase 'plus costs to be taxed' must be given its plain meaning and costs are to be taxed on ordinary principles; because the amount recovered ($50,000) falls within the District Court's monetary jurisdiction as determined at the time the amount was ascertained, s.43(2) applies and the costs are to be assessed on the District Court scale. The appeal is therefore dismissed.
