The court accepted the applicant's evidence, found he was employed by the respondent and was injured while performing work assigned by the respondent; the respondent's defences (unauthorised act, alleged settlement and challenge to Form 2) were rejected; therefore respondent is liable under the Employees' Compensation Ordinance and the statutory provisions (ss9,10,10A and s11(2)) were applied to award HK$326,967 plus costs.
