On the balance of probabilities the court accepted the plaintiff's factual account as credible and coherent, found the addition of the mother's name was to satisfy a BEA self-use mortgage requirement and there was a shared common intention at purchase that the plaintiff was sole beneficial owner; plaintiff's payments and conduct constituted detrimental reliance and it would be unconscionable for the mother to assert beneficial ownership, therefore the mother holds legal title on trust for the plaintiff.
