The Tribunal erred in law in concluding it had no jurisdiction because of the existence of the 28/4/2021 document. Monetary claims under Parts VA and VIA fall within the Labour Tribunal's jurisdiction and the Tribunal may determine whether the document defeats the claimant's statutory rights without requiring the claimant to obtain a separate declaratory order from a higher court; the claim is remitted to the Tribunal to decide those issues on the merits.
