The Applicant's reliance on paragraphs 4 and 13 of the Second Schedule fails because those covenants apply to individual owners not to the owners corporation; Clause 7(IV)(B)(k) cannot be invoked against the Respondent because the DMC separates management of non-domestic (commercial) units from the Respondent's managerial authority; therefore the Respondent is not liable on the pleaded DMC provisions and the application is dismissed.
