On construction of the contract and assessment of evidence the court found Whole Light breached agreed delivery dates (30 April and 10 May 2006), delivered defective yarns and overstated quantities; Turbo-Knit proved certain losses and a settlement note dated 10 July 2006 signed by Mr Wong on or about 15 July 2006 constituted a binding settlement agreement (Mr Wong had actual or apparent authority). The settlement deduction of HK$62,348.45 was allowed and the net judgment for Whole Light was HK$117,551.80 together with contractual interest and a costs order nisi for 50% of plaintiff's costs.
