Where evidence before a magistrate establishes an offence different from that charged and the defect can be cured by amendment, the magistrate is obliged under s.27 to amend the information and proceed; that obligation overrides the discretionary protection in s.32 when the matter is before a magistrate, and failure to amend was legal error requiring remit for amendment and retrial.
