The appeal is dismissed because the trial judge’s adverse credibility and factual findings were justified and should not be disturbed; the power of attorney was validly exercised and, absent special circumstances putting solicitors on notice, third parties and solicitors were entitled to act on a professionally drawn power of attorney; accordingly the mortgages were enforceable against the 5th and 6th defendants.
