Although the failure to disclose the Octopus Card report was a material irregularity, on the balance of probabilities it did not cause such prejudice as to render the trial unfair or to amount to a misuse of process; the Magistrate handled the irregularity appropriately and there was ample evidence to support the conviction, so the appeal is dismissed.
