The Court held that when a solicitor acting for both parties held unconditionally the purchase money and the executed assignment at the agreed completion meeting, the solicitor held the money as agent for the vendor and the sale was completed when the vendor executed and delivered the assignment; accordingly the purchasers had paid the purchase price and the appeal was dismissed.
