Although the appellate judge agreed that the precautions taken on the day were inadequate, the conviction was quashed because the learned magistrate misapprehended the law by holding that the occurrence of the prohibited circumstances shifted the legal burden to the defence; the burden of proof remained on the prosecution and that legal error made the conviction unsafe.
