The Court upheld the Disciplinary Committee's findings that the Solicitor received a $6,575 cash cheque and failed to pay it into the firm's client account, deliberately breached costs rules by discounting, exposed clients to litigation, and therefore committed misconduct (including fraud and conduct bringing the profession into disrepute); the appeal is dismissed and the suspension imposed by the Committee is confirmed; disciplinary proceedings alleging deceit require a high standard of proof though not the criminal standard.
