The magistrate's general policy of absolute discharge for first offences under section 17C(3) was wrong in principle and manifestly inadequate because it failed to give effect to the legislative purpose of deterring illegal immigration; the appropriate starting fine for a first offence lies in the range of $150–$200 with adjustment for aggravating or mitigating factors; the ordinary appellate standard (manifestly excessive/inadequate) applies to reviews under s.81A.
