- Citation
- HKSAR v. LAU PO SING AND ANOTHER
- Court
- Court of Appeal
- Case number
- CACC95/2007
The judge erred by applying a mitigation discount for assistance after fixing total sentences; mitigation for assistance must be reflected by reducing starting points and then assessing totality. Applying that approach, a 40% discount for the 1st applicant's assistance was appropriate. Accordingly the 1st applicant's sentences were re‑assessed and substituted; the 2nd applicant's application was dismissed and his sentence upheld.
