The original sentence of 2 months was manifestly excessive. Having reassessed the facts and comparable authorities the court concluded an appropriate starting point was 6 weeks' custody pre-plea, reduced to 4 weeks after credit for plea. The appeal is allowed and the sentence is reduced to 4 weeks' immediate imprisonment.

The Court refused to certify any of the four questions because none raised points of law of great and general importance: the sentencing approach applied by the trial judge and the Court of Appeal was lawful and properly focused on overall culpability; alleged errors were either misreadings of authority or complaints about the weight given to factors rather than legal principle.

Even if the judge had accepted that one packet was for self-consumption and that reduced the notional trafficking quantity slightly, that potential reduction was effectively counteracted by the applicant's substantial and relevant prior convictions and accumulated sentences; therefore there was no arguable ground that the final sentence of 5 years 4 months was manifestly excessive or wrong in principle and the application for leave to appeal was refused.

The Court held the judge should have stated a starting point; on reassessment the appropriate starting point was 15 months, with a 6‑month uplift for acting in concert and planning, fixing the appropriate sentence after trial at 21 months; accordingly the appeals were allowed in part and the sentences reduced.

The magistrate correctly identified appropriate starting points for each offence, properly applied the principle of totality, accounted for sentences already being served and the plea discount, and the resulting aggregate sentence of 44 months (26 months newly imposed with 22 months consecutive to sentences being served) accurately reflected the defendant's criminality; therefore the appeals were dismissed and sentences confirmed.

Given the significant quantities of heroin, the defendant's admissions of purchasing, packaging and distributing the drug, presence of packaging paraphernalia and a sizable monetary value, the sentencing judge properly adopted appropriate starting points and proportionate reductions for plea; the resultant total sentence of 14 years was not excessive and leave to appeal is refused.

The Magistrate's methodology of discounting a starting point for the guilty plea and then increasing the discounted term for previous convictions is incorrect; the proper method is to increase the starting point to reflect the bad record and then apply the guilty plea discount. Applying the correct approach and balancing submissions, the appropriate sentence is 16 months imprisonment, and the appeal is allowed in part to reduce the sentence from 18 to 16 months.

The police telephone enquiry did not amount to entrapment; the magistrate validly enhanced the starting point for sentencing given the appellant's significant prior convictions and applicable heroin trafficking guidelines, and the reduction for the guilty plea produced a 20-month sentence which was not excessive, therefore the appeal must be dismissed.
