The judge refused admission of the expert report and oral evidence because the proposed evidence was not relevant or necessary to decide the factual issues and legal elements of the charges, the expert could not legitimately opine on the defendants' intentions or state of mind, the matters could be determined from police operational orders, witnesses and video evidence, and the defendants had not acted 'as soon as practicable' under s65DA(1) so the late production failed statutory requirements.
