The summons to vary the Order Nisi is dismissed because the Director acted bona fide and reasonably in issuing the WC Application based on this court's prior adverse findings about Mr Tam's conduct; although Mr Tam's conduct attracted serious criticism it did not meet the high threshold of gross negligence required for a wasted costs order, and on balance the court exercised its discretion not to disturb the Order Nisi while ordering nisi that Mr Tam pay the Director's costs of the summons.
