- Citation
- HKSAR v. TSE NICHOLAS AND ANOTHER
- Court
- Court of First Instance
- Case number
- HCMA39/2003
The Court held the convictions were safe: the particulars were not defective; statutory conspiracy under s159A may be established by an agreement including informed acquiescence or subordinate participation that has the requisite intention to pervert the course of public justice; the magistrate was entitled to accept PW1 as credible despite limited retractions; on the evidence an agreement involving A1 and active assistance by A2 could properly be inferred, therefore appeals dismissed.
