Court found a material statutory defect: BOC did not plead the existence of the charging order in the petition (breach of section 6B) such that the bankruptcy order ought not to have been made; however, exercising its discretion the court refused to annul because the Debtor failed to show he would not be declared bankrupt again and had not provided a satisfactory explanation for his absence, and other challenges (service and valuation) were rejected.
