On the balance of probabilities the respondent's medical evidence that the applicant's deterioration was the natural progression of pre-existing cervical spondylosis is more persuasive; the judge was unpersuaded that the alleged fall or ship motion precipitated or accelerated the disc herniation causing myelopathy and therefore the applicant failed to prove compensable personal injury arising out of and in the course of employment; claim dismissed.
