The court held that it has jurisdiction under Part II of the Mental Health Ordinance to hold an inquiry and make orders in respect of the estate of a person resident outside Hong Kong who has assets in Hong Kong; Sections 7 and 23 do not restrict that jurisdiction nor make Section 23 the exclusive procedure, and whether to exercise jurisdiction is discretionary — here the discretion favoured holding the inquiry and directions were given to set it down.
