The Court held that the appropriate starting guideline sentence for offences under s38AA(1)(a) and (b) is 15 months imprisonment, following the deterrence rationale of So Man-king and for consistency with s38(1); individual adjustment remains available for plea, humanitarian factors, voluntary surrender and previous detention credits, but the guideline must be applied to maintain effective deterrence against unlawful employment by illegal entrants.
