The Magistrate failed to comply with s.109A because he did not obtain and consider external information (such as a Probation Officer's report and a Commissioner of Prisons/After‑care report) about the appellant's circumstances and suitability for a Training Centre; after obtaining those reports on appeal which recommended training centre detention and confirmed suitability, the correct sentence was detention in a Training Centre and the 15‑month imprisonment was quashed and substituted accordingly.
