Defendants failed to invoke Order 12 r 8 within the prescribed time and made no application for extension; consequently they are treated as having submitted to the court's jurisdiction and cannot challenge admiralty jurisdiction by another route. On the merits the trial judge's factual findings that Ocean was the owner were unimpeached and the application to adduce further Patente certificates was refused under Ladd v Marshall. Appeal dismissed.
