Although the verifying affidavit was inadequate under r.26, the statutory notice signed by the petitioners' solicitors was valid as an authorized notice under s.178 and, on the whole evidence including Official Receiver reports, the company was unable to pay its debts; therefore the winding-up order was properly made and the appeal must be dismissed.
