Convictions based on obtaining property by deception must be supported by proof that goods were delivered in return for and at the time of the false representation (the cheque); where cheques were handed over only after delivery the offence charged was not established and convictions must be quashed, but where cheques were delivered contemporaneously there was sufficient evidence and the statutory presumption in s.29(6)(a) could support a finding of knowledge/dishonesty absent adequate rebuttal.
