The applicant's cautioned statement, although admissible as evidence when put in by the Crown, was a bare denial which, together with the other Crown evidence, was insufficient to rebut the statutory presumptions under the Dangerous Drugs Ordinance; any misapprehension by the District Judge about the weight to be given to that statement did not affect the inevitable outcome and the proviso applies, so the conviction is upheld.
