The action was struck out because the plaintiff company had been wound up and section 186 of the Companies Ordinance imposed a statutory stay such that continuation of the District Court action without leave would be an abuse of process; given the existing judgment debt of over HK$4,000,000 in favour of the defendant the dispute must be dealt with in the winding up proceedings in the Companies Court, and the defendant was entitled to defend by applying to strike the action out.
