The Court of Appeal held that the first instance judge did not err in granting an injunction restraining the plaintiff from proceeding with the arbitration because the disputes to be determined by the court overlap and will be resolved in the litigation, the arbitration agreement was not one that the plaintiff could enforce against the defendant, and therefore the injunction was a proper exercise of discretion; the appeal was dismissed and costs were ordered on an indemnity basis.
