The application to rescind or annul the bankruptcy order and to stay the bankruptcy proceedings was refused because the IVA liability to make monthly contributions remained squarely with the bankrupt, the alleged oral agreement did not relieve him of that liability nor bind the creditors, and alleged defects in explanation or fraud by third parties did not affect the creditors' position.
