The court held that a letter of credit does not create an independent obligation between buyer and seller and the special treatment given to bills of exchange should not be extended to letters of credit; because the plaintiff's action was properly treated as an action for the purchase price under the contract of sale there existed a bona fide triable issue as to defects and termination, so summary judgment was inappropriate and the Master's order was set aside.
